By viewing these curriculum courses, you agree to comply with and be bound by the following terms and conditions of use. Viewing or use of these curriculum courses constitutes acceptance of these terms and conditions. Please read these terms carefully as they may impact your legal rights in the event of a dispute between us.
Some courses involve handling animals. Working with animals can be fun and rewarding. However, working with animals can be dangerous. Animals can be unpredictable and can cause injury or death. Parents & instructors should always supervise their students when handling animals.
Just a Couple of Ag Teachers (JACAT) courses are licensed, not sold. Each course subscription comes with an unlimited number of users within your school site. The subscription length is for the fiscal year (365 days). After your first year subscription, users who wish to continue their access to the curriculum course will be invoiced $1,000 annually. Pricing is subject to change at each renewal term. The license does not give you right to, and you may not share login information or rights to use JACAT with other parties, individuals. A violation of this may result in loss of access to the JACAT platform.
This platform may be unavailable from time to time due to routine maintenance requirements or other issues. The producer does not guarantee specific hours of availability. You are responsible for all activities undertaken by you or those under your direction when using this curriculum courses series. Such use and activities are at your own risk.
You shall not use, nor permit others to use, this product in a manner or for a purpose contrary to these terms and conditions of use.
You will not disrupt the functioning of the website or product, solicit another user’s password, or otherwise act in a way that interferes with other users' use of the product. You will not post or distribute any computer program that damages, detrimentally interferes with, surreptitiously intercepts or expropriates any system, data or personal information. You shall not use the website or any content for any purpose that is unlawful or prohibited by these terms and conditions of use. In no event will JACAT’s or its officers, directors or employees be liable for any incidental, indirect, special, punitive, exemplary or consequential damages, whether in contract, tort or any other legal theory, arising out of your use of or inability to use this curriculum courses or any other matter relating to your transaction with the website, including without limitation, loss of revenue or anticipated profits, loss of goodwill, loss of business, loss of data, computer failure or malfunction, injury to self or animals, or any other damages.
It is the producer’s intent to provide the proper technique and handling of animals. However, there is no guarantee or warranty that the animals will react as predicted or that the techniques guarantee a certain result or behavior. Each animal is different and behaves differently.
There are no warranties expressed or implied.
Any legal action arising from the production or use of this product shall be governed by California law and venue shall be in Yolo County, California, without giving effect to any conflict of law principles.
You hereby represent, warrant and covenant for the benefit of JACAT that: (1) You have the legal right and authority to enter into this agreement, and, if you are accepting this agreement on behalf of a minor or other entity, you have the ability to bind the minor and/or the entity; (2) You have the legal right and authority to perform your obligations under this agreement; and (3) All information you provide is correct and current.
These terms and conditions of use set forth the entire understanding of the parties with regard to use of this website and product and supersede any and all prior oral and written agreements or understandings between the parties regarding the subject matter of this agreement. Should any provision of these terms and conditions of use be held invalid, unlawful, or for any reason unenforceable, then the invalid, unlawful, or unenforceable provision shall be severable from the remaining provisions. Such invalid, unlawful or unenforceable provision shall not affect the validity or enforceability of the remaining provisions. JACAT’s failure to exercise or enforce any right or provision of the terms and conditions of use shall not constitute a waiver of such right or provision.
